SECURITY GUARD, CHARGED IN MIDTOWN JEWELRY THEFT, NYC,

NYC-A security guard in a Midtown building where a $4.9 million diamond theft was reported last week was charged with taking some of the stones after workers mistakenly left the jewels in the hallway for trash.

Employees at J. Birnbach Inc. Fifth Avenue apparently thought the three wood boxes containing the stones were old, and so they left them in a trash pile in the public hallway.

The owner realized last Thursday that the jewelry was missing, and detectives quickly concluded that the supposedly empty boxes actually contained the jewelry.

The missing $5 million in diamonds from J. Birnbach Jewlers on 47th St in midtown Manhattan have been found and a suspect has been arrested, NYPD Chief of Detectives Robert Boyce said Wednesday. Wilfred Martinez 48, a security guard in the building came out of the elevator on the third floor and after seeing the discarded boxes discovered the gems which included the 17 carat stone worth $3.2 million along with several other precious items. He promptly proceeded to sell the now stolen merchandise to another jeweler in the building.

Police say a building security guard, 47-year-old Wilfred Martinez, was caught on building surveillance video going through boxes in the hallway on November 24.

Workers renovating the interior of the business threw the boxes out without realizing they contained diamonds, Chief of Detectives Robert Boyce said at a press conference on Thursday.

Martinez saw the boxes and took them into the bathroom, where he consolidated the diamonds into a single box before leaving with them, Boyce said.

He sold some of the diamonds to another dealer for $68,000 – a “bargain price,” Boyce said. He admitted to the theft in a statement to police after his arrest, and investigators have recovered the stones.
