LEOSU Files Motion to Dismiss SPFPA’s Frivolous Lawsuit Over Publication of SPFPA Union Corruption YouTube Videos.

Detroit Michigan – On 5/10/19 LEOSU’s attorney Thomas Nunley had filed a motion with the judge overseeing a case involving a frivolous lawsuit filed by SPFPA President David L. Hickey and the International Union, Security Police and Fire Professionals of America SPFPA over published YouTube organizing video’s created & uploaded in New York exposing SPFPA union corruption within its organization. You can view LEOSU’s motion to dismiss here.
Below are other related documents and exhibits relating to this case.

Affidavit of LEOSU

SPFPA News Articles

SPFPA Election Results

LEOSU Organizing Director Steve Maritas noted he is not worried about this frivolous lawsuit filed by Hickey and the SPFPA union since the Truth is an absolute defense.

THE DEFENDANT LEOSU UNION ELECTION VIDEOS, POSTED ON “YOUTUBE.COM” ARE ALL EXPLICITLY AND ABSOLUTELY TRUE – PROTECTED SPEECH UNDER THE FIRST AMENDMENT

The Defendant LEOSU videos were all carefully written and researched with factual verification and documentation. The truth is that Plaintiff SPFPA has had dozens of its officers criminally indicted and convicted. (See News Articles and Reports of SPFPA Officer convictions attached as Exhibit “A”).

The truth is that Defendant LEOSU has beaten Plaintiff SPFPA in over a dozen contested union elections. (See SPFPA Losses and NLRB Records attached as Exhibit “B”)

The truth is that the FBI did raid the home of Plaintiff David Hickey. See Newsmax Article

The truth is that Plaintiff SPFPA has a long history of corruption and embezzlement under the leadership of Plaintiff David Hickey, who has been at the helm of Plaintiff SPFPA since 2000.

The truth is a complete defense to a defamation action. See Andrews v. Prudential Sec., 160 F.3d 304, 308 (6th Cir. 1998); See also Baggs v. Eagle-Picher Indus., Inc., 957 F.2d 268, 273 (6th Cir. 1992) (citing Cochrane v. Wittbold, 359 Mich. 402, 102 N.W.2d 459, 463 (Mich. 1960)). This privilege extends to a great variety of subjects, and includes matters of public concern, public men, and candidates for office.” New York Times Co. v. Sullivan, 376 U.S. 254, 281-82 (1964).

DEFENDANTS’ FIRST AMENDMENT RIGHTS TO POST AND USE VIDEOS IN
NEW YORK AND WASHINGTON D.C. – ARE PROTECTED SPEECH – WITH
ANTI-SLAPP LIABILITY AGAINST PLAINTIFF – WHICH PLAINTIFF IS TRYING TO ILLEGALLY INVADE

The Plaintiffs are waging a campaign to try to “crush” the Defendants labor union, LEOSU. This “harassment campaign” has included Plaintiffs’ posting over fifty (50) “YouTube” videos attacking Defendant LEOSU, and Defendant Maritas, and filing multiple fraudulent lawsuits, to run-up Defendants’ attorney fees.

Plaintiffs’ David Hickey and SPFPA openly admit their illegal and fraudulent harassment strategy against the Defendants in mocking and threatening emails.

See the attached email from Plaintiff SPFPA to Defendant Maritas, boasting of
illegitimate legal tactics (See Exhibit “C”). See also the e-mail dated May 10, 2019 by the Plaintiff David Hickey sent to union members – boasting of his strategy of costly and fraudulent litigation as a strategy to consume the union dues of Defendant union’s members. (See Exhibit“D”).

Plaintiffs’ strategy is simple: force Defendants to expend union member dues on litigation; and then accuse Defendant of “wasting” union members’ dues on litigation.

Plaintiffs’ intend to attempt to escape New York’s and Washington D.C.’s “anti-SLAPP” laws. “SLAPP” is an acronym for a “strategic lawsuit against public participation.” Ernst v. Carrigan, 814 F.3d 116, 117 (2d Cir. 2016). “SLAPP suits come in many forms camouflaged as ordinary lawsuits. The conceptual thread that binds them is that they are suits without substantial merit that are brought by private interests to ‘stop citizens from exercising their political rights or to punish them for having done so.’” Gordon v. Marrone, 590 N.Y.S.2d 649, 656 (1992); (citing Pring, SLAPPs: Strategic Lawsuits Against Public Participation, 7 PACE ENVTL LREV 3 [1989]).

SLAPP suits function by forcing the defendant into a judicial proceeding where the plaintiff can force the expenses of a defense upon the target defendant. See Gordon, 590 N.Y.S.2d 649 (1992). As the emails discussed above show, Plaintiffs’ only purpose in this frivolous action is to waste Defendant’s resources and “bleed the Defendants dry.” (See Exhibit “D”-mass e-mail from Plaintiff David Hickey to LEOSU members explaining Plaintiffs’ frivolous litigation strategy).

Plaintiffs’ should not be rewarded by filing in Michigan’s Courts, where only Plaintiff has contacts, to harass a rival union and its members.

YouTube has once again Terminated SPFPA’s PHONY Anti-LEOSU Youtube Account Once Again yesterday after repeated malicious and repeated harassment as well as Copyright Violations by SPFPA.

For the past year the International Union, Security Police & Fire Professionals of America SPFPA, has repeatedly posted childish defamatory anti-LEOSU cartoon videos on its SPFPA YouTube account attacking the LEOSU organization but also its Organizing Director Steve Maritas.

Secretly the SPFPA, was using and texting these anti-LEOSU YouTube videos to potential new members in their attempt to persuade these potential new members not to join the Law Enforcement Officers Security Unions LEOSU. Their efforts was not successful as the the LEOSU was able to win a number of new units from around the country, most notably the Paragon System, Inc protective service officers protecting the federal buildings at 26 Federal Plaza as well as 28 other locations in New York city, the Bronx & Westchester.

With a series of backlash comments from SPFPA YouTube subscribers and non subscribers on these childish defamatory anti-LEOSU cartoon videos created by SPFPA, they must of decided to change tactics and on Monday 4/15/19 they removed these childish defamatory anti-LEOSU cartoon videos from their SPFPA YouTube account and intern created a “PHONY” ANTI-LEOSU account. They then proceeded to upload these old videos as well as some new videos on to this “PHONY” account in their attempt to hide their (SPFPA’s) identity.

After being notified by our LEOSU supporters of SPFPA’s change of tactics, our attorneys immediately sprung into action and the Union began filing harassment complaints as well as copyright violations against SPFPA’s “PHONY” new ANTI-LEOSU YouTube account. Within two days YouTube terminated this account.

One of several of the SPFPA “PHONY” ANTI-LEOSU YouTube Videos that was removed. We suspect SPFPA President David L. Hickey ordered these attacks and SPFPA Organizing Director Dwayne Phillips created this ‘PHONY” YouTube account and all of its SPFPA childish defamatory anti-LEOSU cartoon videos.

SPFPA Union Busting Rats, SPFPA Corruption, SPFPA Embezzlement

Beware of SPFPA UNION-BUSTING Rats who encourage MGM Springfield Casino security Officers to VOTE NO UNION.

What do you call a Security Police Union that encourages MGM Springfield Casino security officers to VOTE NO Union?

SPFPA UNION-BUSTING RAT UNION!

This is what exactly happened when the MGM Springfield Casino Law Enforcement Officers Security Union. LEOSU was attempting to organize MGM Springfield Casino security officers in Springfield Massachusetts.

The LEOSU has filed federal charges with the National Labor Relations Board calling for an investigation against the International Union, Security Police & Fire Professionals of America SPFPA for its violations of 102.62(d).

See supporting documents against SPFPA here.

On November 26, 2018 David L. Hickey, President & Organizing Director of SPFPA and its agents / representatives, using a Board approved eligibility list it received when they intervened in & thereafter withdrew from Case No. 01-RC 230330, texted messaged MGM Springfield Casino security professionals less than 12 hours prior to a scheduled NLRB vote a ANTI-UNION BUSTING – ANTI-LEOSU YouTube video urging these bargaining unit members to VOTE NO on Tuesday November 27th.

The purpose of this SPFPA ANTI-UNION BUSTING – ANTI-LEOSU YouTube video was to openly assist MGM Springfield in winning this election in Case No. 01-RC 230330 as well as to interfere with and restrain the pending vote scheduled for Tuesday November 27, 2018 between MGM Springfield & LEOSU and its affiliate union MGM Springfield Casino Law Enforcement Officers Union. Mr. Hickey’s and SPFPA representative Dwayne Phillips as well as other

SPFPA representatives has misused the MGM Springfield voter eligibility list after SPFPA withdrew from this election lacking support and fearing another loss to LEOSU, as well as for the purposes of assisting MGM Springfield in this election and at the same time for the purposes of retaliating against the LEOSU and its affiliated unions and its members & potential members, has violated Board Rule No. 102.62(d).

By the foregoing and other acts, the SPFPA and its agents David L. Hickey & Dwayne Phillips, and other SPFPA agents/ representatives, have restrained and coerced employees in the exercise of the rights guaranteed in Section 7 of the Act.

Braidwood Nuclear Security Officers Deserve the Real Truth and are requesting SPFPA President to Release the Transcripts of the Hearing.

Chicago, IL, February 21, 2018: The National Labor Relations Board held a hearing in Case No. 13-RC-212795 at the Dirksen Federal Bldg, 219 S Dearborn St #808, Chicago, IL 60604 after objections were filed in this case claiming many violations against the International Union, Security Police & Fire Professionals of America SPFPA’s conduct during the critical period of a union election held on January 30th and 31st 2018 at Braidwood Generating Station in Braidwood, IL.

During this NLRB hearing two (2) Exelon Braidwood nuclear security officers testified to the fact that SPFPA President David L. Hickey attempted to bribe these two officers by offering them both positions on the Union Board if they would withdraw their support for a rival union who was competing against SPFPA for the right to represent these Exelon Braidwood nuclear security officers at the bargaining table.

  • It should be noted while these two (2) Exelon Braidwood nuclear security officers did in fact testify against Hickey about this bribe allegation at the hearing and Hickey failed to appear at the hearing in his own defense.
  • SPFPA President David L. Hickey’s failure to appear at the NLRB Board Hearing in his own defense to this bribe allegation, raises even more speculation that this event actually did happened and this could be the reason why Hickey failed to appear and/or to try to clear his name.
