The Law Enforcement Officers Security Unions LEOSU was victorious in defeating both SPFPA & PROA, winning this Paragon Systems 4 way NLRB Election to have the privilege and right to represent the Paragon Systems Inc protective service officers in Louisville, Kentucky.

On 8/15/2019 the National Labor Relations Board has certified the results of this Paragon Systems election.

In a stunning landslide NLRB election, the Law Enforcement Security Officers Union (“LEOSU”) won the representation election and will be representing the protective service officers PSO’s at Paragon Systems, Inc protecting federal facilities throughout Louisville Kentucky which includes Romano Mazzoli Federal Building, Gene Snyder U.S. Courthouse and Custom House, United States Attorney’s Office, Immigration Court Heyburn Building, SSA and the Immigration and Customs Enforcement (ICE) formally represented by the Protection and Response Officers of America PROA a Georgia state based union.

This National Labor Relations Board (NLRB) election was not your typical NLRB election, due to the fact that the unit being sought, the entire Commonwealth of Kentucky contract, which was represented by the incumbent union PROA, had been awarded to a new Federal Protective Service contractor Patronus Systems Inc as of July 1, 2019. Since Patronus Systems Inc was to take over this federal protective service contract on July 1, 2019, and at the time the petition was filed they were not the legal employer, nor did they employ any of the protective service officers on the Commonwealth of Kentucky contract, the NLRB set this case 09-RC-243304 for hearing.

In addition to the above the LEOSU had filed a motion to remove SPFPA from the ballot if Patronus Systems Inc remained on the ballot. The reason for this was due to the fact Patronus Systems Inc was owned by Mabel O’Quinn wife of SPFPA International Union Region 2 Vice President Rick O’Quinn.

The ownership of Patronus Systems Inc by Mabel O’Quinn wife of SPFPA Region 2 Vice President Rick O’Quinn Clearly created a CONFLICT of INTEREST.

After much discussion at this NLRB hearing on this Conflict of Interest between Patronus Systems Inc President Mabel O’Quinn and her husband SPFPA Region 2 Vice President Rick O’Quinn and the appropriateness of unit and if in fact Patronus Systems Inc could be viewed as a joint employer of Paragon, which is now a major subject of litigation before the Board as to what constitutes a “JOINT EMPLOYER” the LEOSU decided to amend its original petition rather than to face possible years of legal litigation, to only include the Paragon Systems protective service officers working in Louisville, Kentucky, who were to remain as a subcontractor on this contract after the July 1st date. In the end the NLRB Acting Regional director determined and agreed with the LEOSU that the Paragon PSO’s working in the Louisville Kentucky was an appropriate unit and ordered an NLRB mail ballot election.

After LEOSU called the election, the rival Security Police and Fire Professionals of America (“SPFPA”) who has a long history of corruption & embezzlement intervened in the election, with SPFPA’s President David Hickey personally flying to Kentucky to campaign in the election and committing to be the lead negotiator should SPFPA be selected as their new collective bargaining agent, SPFPA then launched what one union observer described as a “scorched-earth” campaign to demonize the rival union.

SPFPA has a Long History of Corruption & Embezzlement Under The Leadership of David L. Hickey. Security and Fire Professionals President in Detroit Pleads Guilty. On July 19, 2019, Esper Alexander, former president of Security, Police and Fire Professionals of America Local 1111, pleaded guilty in Wayne County (Michigan) District Court to one count of larceny by conversion of funds from the Detroit-based union. The plea follows an investigation by the U.S. Labor Department’s Office of Labor-Management Standards.

SPFPA’s President David Hickey personally flew to Kentucky to campaign in the election and committing to be the lead negotiator should SPFPA be selected as their new collective bargaining agent, SPFPA then launched what one union observer described as a “scorched-earth” campaign to demonize the rival union.

In the election, despite SPFPA’s dirty propaganda tactics, as well as Hickey’s vicious lies and desperation promises, LEOSU beat and won this NLRB election with 16 votes, to only 4 votes for SPFPA.

Most recently the LEOSU was successful in organizing the 318 Paragon Systems, Inc protective service officers (PSO’s) working at and in charge of protecting thirty (30) federal facilities throughout New York City, the Bronx and Westchester. This includes 26 Federal Plaza, 290 Broad Street, DEA, Bowling Green and 201 Varick Street, which was a target of a deadly shooting of protective service officer Idrissa Camara back on August 21, 2015.

The LEOSU and its affiliate unions have also been successful in defeating the SPFPA in several other elections including the Department of Transportation, Federal Aviation Administration, GSA ROB Building, NASA HQ, Georgetown University, Catholic University and the Russell Knox Building in Quantico after SPFPA disclaimed interest in this group after LEOSU had filed an election.

Washington DC & New York City – The Law Enforcement Officers Security Unions LEOSU & LEOSU-DC won two major National Labor Relations Board (NLRB) decisions in two separate regions, region 5 and region 29 concerning Paragon Systems, Inc. In the Washington DC NLRB decision the Board ruled in Case 05-RC-234968  that the Board has  considered the evidence and arguments presented by the parties, and for the reasons described below, I conclude that the Intervenor has not established that either a Contract or successor bar applies in this case. Accordingly, the Board conclude that a question concerning representation exists,and they are directing an election in this matter.

Soon after this NLRB decision the Federal Contract Guards of America FCGOA, disclaimed all interest in this group and Paragon Systems, Inc then legally recognized the LEOSU as the exclusive bargaining collective representative for All full-time and regular part-time protective security officers and sergeants employed by the Employer performing guard duties at the United States Citizenship and Immigration Services facilities currently located at 20 Massachusetts Avenue, NW, and 111 Massachusetts Avenue, NW, Washington, D.C.; but excluding all office clerical employees, professional employees, managerial employees, and supervisors as defined in the Act.

In another NLRB decision handed down by the NLRB on May 15, 2019, in Case No. 29-RC-229372 against the National League of Justice and Security Professionals (NLJSP) the Board ruled in its  HEARING OFFICER’S REPORT AND RECOMMENDATIONS ON OBJECTIONS that this report contains my findings and recommendations regarding the Petitioner’s objections to the election in the above referenced case. For the reasons contained herein, I recommend overruling the Petitioner’s objections and issuing a Certification of Representative.

Upon a petition filed on October 15, 2018, by National League of Justice and Security Professionals (NLJSP), herein called the Petitioner, and pursuant to a Stipulated Election Agreement signed by the Petitioner, Paragon Systems, Inc., herein called the Employer, and by Law Enforcement Officers Security Unions LEOSU, LEOS-PBA, herein called the Intervenor, and approved by the Acting Regional Director on February 11, 2019, an election by mail ballot was conducted on February 25, among the employees employed in the following unit: All full-time and regular part-time armed and unarmed security officers employed by Paragon Systems, Inc. at the Federal Protective Service sites located in Manhattan, the Bronx, West Nyack, Yonkers, New Rochelle, White Plains, and Peekskill, New York, covered under Paragon Systems, Inc.’s June 1, 2018, service contract with the United States Government, but excluding all other employees and supervisors as defined by Section 2(11) of the Act.

The Tally of Ballots, made available to the parties pursuant to the Board’s Rules and Regulations on March 20, showed the following results:

Number of ballots cast for the Intervenor 167
Number of votes cast against participating labor organization 34

Challenges are not sufficient in number to affect the results of the election. A majority of the valid votes counted has been cast for the Intervenor.

Recommendation

I have recommended overruling the Petitioner’s objections.

Accordingly, I further recommend that the Intervenor be certified as the exclusive collective bargaining agent of the following appropriate unit: All full-time and regular part-time armed and unarmed security officers employed by Paragon Systems, Inc. at the Federal Protective Service sites located in Manhattan, -the Bronx, West Nyack, Yonkers, New Rochelle, White Plains, and Peekskill, New York, covered under Paragon Systems,. Inc.’s June 1, 2018, service contract with the United States Government, but excluding all other employees and supervisors as defined by Section 2(11) of the Act.

With this major ruling by the NLRB on May 15, 2019, in favor of LEOSU and against the National League of Justice and Security Professionals (NLJSP) it seems this was a death blow for the NLJSP who at a membership of just 175 members had just disclaimed interest in a unit consisting of 70 members at the National Oceanic and Atmospheric Administration as well as disclaiming interest at the Department of Education and Housing and Urban development Facility another Paragon Systems, Inc unit in Washington DC, Case Number: 05-RC-241434.

Clinton Illinois January 17, 2019 & January 18, 2019. Ninety four (94) Exelon Clinton nuclear security officers had their voices heard when they voted to be represented by the National Union of Nuclear Security Officers NUNSO a division of LEOSU. The National Union of Nuclear Security Officers NUNSO, is the only Nuclear Security Union in the United States that specializes in the exclusive representation of Nuclear Security Officers for the purposes of mutual aid & protection as well as collective bargaining.

NUNSO was founded by three Exelon Braidwood nuclear security officers, Victor Nichols, Joe Thompson and Jesse Wordlaw who saw a need to form a real nuclear security union that only focuses on representing nuclear security officers.

During this campaign our union not only had to combat the employer, Exelon, but we also had to combat the incumbent union SEIU Local 1 who was prohibited from being on the ballot based on Section 9(b)3 of the Act, because they are a mixed guard union, as well as SPFPA who had intentionally and maliciously  interfered in our election. Both the Employer, SEIU Local 1 and SPFPA openly ran a vote NO Union-Busting campaign, with SPFPA leading the charge by producing several Union-Busting Rat Union YouTube vote NO videos, which were texted anonymously to these Exelon Clinton nuclear security officers.

In the end these Exelon Clinton nuclear security officers were not fooled by these SPFPA union busting rat union tactics by the corrupt  SPFPA  union and intern voted YES to join NUNSO / LEOSU. We wish to welcome these 94 Exelon Clinton nuclear security officers to the NUNSO / LEOSU family.

Presently, Exelon has 5 other Nuclear facilities in the area which includes Byron Generating Station, LaSalle County Generating Station, Dresden Generating Station, Quad Cities Generating Station and Braidwood Generating Station. Over the next few months the Union is planning to reach out to the other nuclear security officers at each facility as a way to build greater strength, solidarity and better communication among the Exelon officers.

Washington, DC 6-27-2017 – The Law Enforcement Officers Security Unions LEOSU-DC was successful in beating not one security union, but rather two (2) security unions SPFPA and FAPO to gain the privilege of representing the one hundred and fifty one (151) protective service officers working for Quality Investigations inc (QI) @ the Department of Transportation (DOT) and Federal Aviation Administration (FAA) in Washington, DC on June 27th.

On May 16th the National Labor Relations Board (NLRB) conducted a mail ballot election Case Number 05-RC-195970, whereby these QI protective service officers had to choose between three (3) security unions on the ballot. After all was said and done, none of the three unions received a majority vote, which lead to the two top unions receiving the most votes to battle head to head in a runoff election.

In the end the  Law Enforcement Officers Security Unions LEOSU-DC became the victor.

Washington DC – On Good Friday, April 14, 2017, the National Labor Relations Board concluded the mail ballot election in case number 05-RC-194020 between the Law Enforcement Security Unions LEOSU-DC and the Security Police Fire Union from Roseville, Michigan which has a long history of embezzlement and corruption as well as many Department of Labor and NLRB violations to determine who will have the privilege of representing the security officers, security assistants, security specialists, and security receptionists working for Security Support Services, LLC, at NASA headquarters in Washington DC.

In the end, when all was said and done, the Law Enforcement Security Unions LEOSU-DC was the victor, winning in a landslide victory and the Security Police Fire Union losing in an embarrassing loss receiving only 4 votes out of 43 votes.

Steve Maritas, Organizing Director of LEOSU-DC noted this landslide victory by LEOSU-DC clearly shows that these NASA security officers were fed up with the lack of service and the lack of representation by the Security Police Fire Union. Noting that many of these NASA officers have complained that this union hasn’t been seen or heard from in almost 3 years. Once LEOSU-DC filed an election all of sudden Security Police Fire Union Region 4 Vice President Joseph McCray wanted to hold meetings to find out what was some of the problems at this facility. “Where has this union been for 3 years?” noted one NASA security Officer.

What makes this victory so sweet noted LEOSU-DC Organizing Director Steve Maritas, is that on April 11, 2017 the Security Police Fire Region 4 Vice President sent an email to Security Police Fire Union President David L. Hickey mocking Maritas.  In this email exchange that was cc to Maritas, the Security Police Fire Union took the low road of name calling as well as claiming “SPFPA has all the Aces” -“You called Down the Thunder Well You Got It” stated McCray.

In the end the “LEOSU-DC had the last laugh” stated Maritas. As to McCray, Maritas noted “the immaturity of both McCray & Security Police Fire International President David L. Hickey”clearly shows you the kind of security union they really are. Between the lack of leadership, the immaturity and all the corruption & embezzlement going on at the Security Police Fire Union, it is no wonder why, so many members are leaving this organization, approximately 15,000 members since 2013”. Stated Maritas.

Maritas also noted that “there are only four (4) aces in a deck of cards which is exactly the same number of votes the Security Police Fire Union received in the NASA HQ election”.

In the next few weeks the officers working at the Department of Transportation in Washington DC and the campus safety officers & dispatchers working at Trinity College now represented by the Security Police Fire Union will have an opportunity to decertify them and vote for LEOSU-DC & LEOSU-CT representation.

Federal Settlement Forces Security Police Fire Union Officials to Refund $20,000 After Illegally Seizing Union Dues from Security Officers @ Ronald Reagan Building in Washington DC.

Washington, DC (April 3, 2017) – With free legal assistance from National Right to Work Foundation staff attorneys, two Washington D.C. area workers have won a federal settlement from International Union of Security, Police Fire Union officials. The settlement dictates that union officials pay back approximately $20,000 in illegally seized dues, with interest.

The two workers, Troy Golson and Yasir Maatoug, work as security guards in the Ronald Reagan Building in downtown Washington, D.C. In November 2015, employees in their company, Coastal International Security, won a deauthorization election against the Security Police Fire Union. A deauthorization election can be called by employees to negate the forced-unionism clause that allows union bosses to have a worker fired for refusing to pay the union dues or fees.

After the successful deauthorization vote, more than 30 Coastal employees sent union officials a dues check-off revocation letter, which legally stops the collection of forced union dues from their paychecks. However, Security Police Fire Union officials ignored some of the letters and continued seizing dues from many employees’ paychecks, erroneously claiming workers could not stop payment except in a union-determined “window period.”

Under current National Labor Relations Board law, workers who win a deauthorization election have the right to halt automatic deductions from their paychecks immediately simply by sending the union a revocation letter.

The settlement also allows for other workers to receive refunds for illegally seized dues if they can show that they revoked their dues check-off following the deauthorization election in November of 2015. Furthermore, Security Police Fire Union officials must post and e-mail a notice stating that they “will not collect dues from bargaining unit employees who have revoked their authorizations for payroll deduction of union dues or fees following the deauthorization of the union security clause.”

“This case epitomizes the lengths to which Security Police Fire Union officials will go to collect every last cent of forced dues they can, even in violation of longstanding law,” said Mark Mix, President of the National Right to Work Foundation. “Even after a majority of the very workers the union claims to ‘represent’ voted to strip Security Police Fire Union officials of their forced dues powers, Security Police Fire Union union officials continued to illegally seize thousands of dollars in forced dues from them.

Richmond, VA – On Saturday December 10, 2016, seventy (70) Allied Universal security officers working on the Richmond, VA city contract were called to a meeting and told by upper management they would be losing their vacation days and 401k benefits. Immediately following the meeting several Allied Universal security officers contacted LEOSU-DC Organizing Director Steve Maritas and asked what could the union do to help these officers.

Richmond, VA –  On Saturday December 10, 2016, seventy (70) Allied Universal security officers working on the Richmond, VA city contract were called to a meeting and told by upper management they would be losing their vacation days and 401k benefits. Immediately following the meeting several Allied Universal security officers contacted LEOSU-DC Organizing Director Steve Maritas and asked what could the union do to help these officers.

LEOSU-DC Organizing Director Steve Maritas immediately sprang into action advising these Allied Universal security officers to go online to our website and signup to join our union. Within 24 hours of the call for help the Law Enforcement Officers Security Unions LEOSU-DC had signed close to the majority of these Allied Universal security officers. Upon having the support needed to file an election with the National Labor Relations Board, the union electronically filed an election with the NLRB on Sunday night and thereafter notified Allied Universal of our NLRB petition. By morning Allied Universal upper management were in a tailspin seeing the quick action of the union as well as the solidarity of these Richmond, VA security officers banding together as a united front.

By Monday morning, these 70 Allied Universal security officers were receiving emails from the company informing them that their vacation pay and 401k benefits would no longer be taken away from them by the company.  SEE ALLIED UNIVERSAL LETTER.

Maritas noted, “while we were successful in gaining back the vacation days, 401k benefits and other benefits of these Allied Universal security officers in Richmond, VA, we must now continue to move forward, not backwards as the union seeks to not only protect the wages, benefits and other conditions of employment these officers presently enjoy, but rather we must move forward in improving these wages, benefits and working conditions as well as providing “JOB SECURITY” since these (70) Allied Universal security officers are still “AT-WILL” employees subject to firing without just cause”. “That is why it is so important to have a union and a union contract in place so management cannot just fire its employees “AT-WILL” nor can they take away their benefits “AT-WILL” as in the case of these (70) Allied Universal security officers”. noted Maritas.

The union expects the NLRB will conduct a mail ballot election within the next few weeks. Upon winning the union election the LEOSU-DC will be certified as the collective bargaining agent for these Allied Universal officers and then we will begin the process of collective bargaining to improve the wages benefits and other conditions of employment for these Allied Universal Richmond, VA security officers.

Please see the message that was sent to me and DelMar regarding the Anniversary Bonus/Vacation Policy contained in the employee handbook. Please use the talking points (highlighted in yellow below) with your teams and ensure any communications reinforce this message.

The great news is that through a tremendous amount of collaboration between many departments, we were able to finalize the new S/P Employee Handbook* and get this sent out to start providing our managers, supervisors and S/Ps with some needed guidance on key policies like attendance, work rules and performance expectations.

This Handbook contains our “go forward” approach for new accounts relative to the Anniversary Bonus Program, which is provided annually to employees as a recognition for service.  This part of the Handbook is intended to represent the standard program for the vast majority of legacy Universal accounts, and the standard for new accounts sold going forward.

Unfortunately, in the focus on the handbook getting launched in general, we missed on pre-communicating what that section means to existing employees in legacy AB accounts that currently have vacation plans, and those employees in union or client-contract accounts that require a traditional vacation plan.  This has created some confusion with primarily legacy AB Managers.  

This email is to further clarify this and provide you with bullet points for follow up discussions with your leadership teams:

  • There is no change to any accounts or jobs at this time – whatever program is in place today, remains in place until further notice.  NO action is required, nothing new should be relayed to S/Ps, and all employees should be advised that whatever program they are on today remains in effect regardless of language in the Handbook – it does not alter their current program.  Specifically:

o   Legacy AB account with standard AB vacation plan – remains in effect as currently administered

o   Legacy AB or Universal Union account that requires union – remains in effect as currently administered

o   Legacy AB or Universal non-union account that contractually requires vacation – remains in effect as currently administered

o   Legacy Universal account currently using Anniversary Bonus Program – remains in effect as currently administered

o   Legacy Universal account currently using Grandfathered Anniversary Bonus Program (i.e., acquisition account) – remains in effect as currently administered

  • We continue to evaluate an overall transition plan regarding integrating and standardizing our approach to S/P vacation programs – Universal and AB had very different approaches, and thoughtful work is going into considering the best strategy for the Company and employees.
  • We will involve the senior leadership and HR teams in the development of any communications related to this.
  • If any alterations to plans were to occur, they would NOT involve client-contracted or union accounts – those would remain intact regardless of any transitions that occur.  For non-union/non-contract specified accounts (i.e., other legacy AB accounts that have an AB vacation plan currently), the annual dollar value of the current vacation benefits would NOT be impacted in an transition plan that is developed.
  • Questions regarding the language in the Handbook can be directed to the HRDs, but the message very simply is that the Handbook section regarding the Anniversary Bonus Program applies to all existing accounts that currently have this benefit, and to new accounts that get sold that do not otherwise have a vacation program specified.

The National Labor Relations Board protects the rights of most private-sector employees to join together, with or without a union, to improve their wages and working conditions.

Section 7 Rights and Freedoms

Employees have the right to unionize, to join together to advance their interests as employees, and to refrain from such activity. It is unlawful for an employer to interfere with, restrain, or coerce employees in the exercise of their rights. For example, employers may not respond to a union organizing drive by threatening, interrogating, or spying on pro-union employees, or by promising benefits if they forget about the union.

Section 7 of the National Labor Relations Act (the Act) guarantees employees “the right to self-organization, to form, join, or assist labor organizations, to bargain collectively through representatives of their own choosing, and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection,” as well as the right “to refrain from any or all such activities.”

Section 8(a)(1) of the Act makes it an unfair labor practice for an employer “to interfere with, restrain, or coerce employees in the exercise of the rights guaranteed in Section 7” of the Act. For example, you may not

  • Threaten employees with adverse consequences, such as closing the workplace, loss of benefits, or more onerous working conditions, if they support a union, engage in union activity, or select a union to represent them.
  • Threaten employees with adverse consequences if they engage in protected, concerted activity. (Activity is “concerted” if it is engaged in with or on the authority of other employees, not solely by and on behalf of the employee himself. It includes circumstances where a single employee seeks to initiate, induce, or prepare for group action, as well as where an employee brings a group complaint to the attention of management. Activity is “protected” if it concerns employees’ interests as employees. An employee engaged in otherwise protected, concerted activity may lose the Act’s protection through misconduct.)
  • Promise employees benefits if they reject the union.
  • Imply a promise of benefits by soliciting grievances from employees during a union organizing campaign. (However, if you regularly solicited employee grievances before the campaign began, you may continue that practice unchanged.)
  • Confer benefits on employees during a union organizing campaign to induce employees to vote against the union.
  • Withhold changes in wages or benefits during a union organizing campaign that would have been made had the union not been on the scene, unless you make clear to employees that the change will occur whether or not they select the union, and that your sole purpose in postponing the change is to avoid any appearance of trying to influence the outcome of the election.
  • Coercively question employees about their own or coworkers’ union activities or sympathies. (Whether questioning is coercive and therefore unlawful depends on the relevant circumstances, including who asks the questions, where, and how; what information is sought; whether the questioned employee is an open and active union supporter; and whether the questioning occurs in a context of other unfair labor practices.)
  • Prohibit employees from talking about the union during working time, if you permit them to talk about other non-work-related subjects.
  • Poll your employees to determine the extent of their support for a union, unless you comply with certain safeguards. You must not have engaged in unfair labor practices or otherwise created a coercive atmosphere. In addition, you must (1) communicate to employees that the purpose of the poll is to determine whether the union enjoys majority support (and that must, in truth, be your purpose); (2) give employees assurances against reprisal; and (3) conduct the poll by secret ballot.
  • Spy on employees’ union activities. (“Spying” means doing something out of the ordinary to observe the activity. Seeing open union activity in workplace areas frequented by supervisors is not “spying.”)
  • Create the impression that you are spying on employees’ union activities.
  • Photograph or videotape employees engaged in peaceful union or other protected activities.
  • Solicit individual employees to appear in a campaign video.
  • Promulgate, maintain, or enforce work rules that reasonably tend to inhibit employees from exercising their rights under the Act.
  • Deny off-duty employees access to outside nonworking areas of your property, unless business reasons justify it.
  • Prohibit employees from wearing union buttons, t-shirts, and other union insignia unless special circumstances warrant.
  • Convey the message that selecting a union would be futile.
  • Discipline or discharge a union-represented employee for refusing to submit, without a representative, to an investigatory interview the employee reasonably believes may result in discipline.
  • Interview employees to prepare your defense in an unfair labor practice case, unless you provide certain assurances. You must communicate to the employee the purpose of the questioning, assure him against reprisals, and obtain his voluntary participation. Questioning must occur in a context free from employer hostility to union organization and must not itself be coercive. And questioning must not go beyond what is needful to achieve its legitimate purpose. That is, you may not pry into other union matters, elicit information concerning the employee’s subjective state of mind, or otherwise interfere with employee rights under the Act.
  • Initiate, solicit employees to sign, or lend more than minimal support to or approval of a decertification or union-disaffection petition.
  • Discharge, constructively discharge, suspend, layoff, fail to recall from layoff, demote, discipline, or take any other adverse action against employees because of their protected, concerted activities.
