Allied Universal Officers Richmond Virginia, Allied Universal Security Guards Join Union, LEOSU-DC

Richmond, Virginia – On January 24, 2017, Fifty two Allied Universal armed and unarmed security officers working at various sites throughout the city of Richmond, which includes City Hall, voted to Unionize with the Law Enforcement Officers Security Unions (LEOSU-DC) in a landslide victory, with the employer Allied Universal receiving only 4 total votes.

LEOSU-DC Organizing Director Steve Maritas, noted that from the onset of this campaign these Allied Universal Richmond security officers set a course to unionize and never looked back, after their employer Allied Universal, had notified them back on December 10, 2016,  that these Allied Universal Richmond officers were going to lose their vacation benefits as well as their 401k benefits as part of a nationwide company policy change as noted in their 2017 Allied Universal Employee Handbook.

Within 2 days of this special meeting of Allied Universal Richmond security officers, the union, LEOSU-DC filed an NLRB election to represent these Allied Universal Richmond security officers. Immediately upon the filing of this election Allied Universal reinstated the benefits it had taken from these Allied Universal Richmond security officers, claiming it was a mistake as noted in this Allied Universal letter.

Since the publishing of our original post on December 13, 2016 – Allied Universal Security Officers in Richmond Virginia Get Their Vacation and 401k Benefits Back after LEOSU-DC Files an Election with the NLRB to Represent Them the union has received many calls from Allied Universal security officers claiming they to have lost their vacation benefits as part of the new 2017 Allied Universal nationwide policy.

In addition to the vacation benefits being taken away, many Allied Universal security officers from around the country have also noted the low pay they are receiving. In Richmond Virginia the armed Allied Universal Richmond security officers working on the city contract are only making $13.50 per hour. While the unarmed Allied Universal Richmond security officers are only making $10.00 per hour.

This is not a living wage, this is more like poverty wages and we plan to bring our fight for $15 to the attention of Richmond, VA Mayor Levar M. Stoney, noted Maritas.

The National Labor Relations Board protects the rights of most private-sector employees to join together, with or without a union, to improve their wages and working conditions.

Section 7 Rights and Freedoms

Employees have the right to unionize, to join together to advance their interests as employees, and to refrain from such activity. It is unlawful for an employer to interfere with, restrain, or coerce employees in the exercise of their rights. For example, employers may not respond to a union organizing drive by threatening, interrogating, or spying on pro-union employees, or by promising benefits if they forget about the union.

Section 7 of the National Labor Relations Act (the Act) guarantees employees “the right to self-organization, to form, join, or assist labor organizations, to bargain collectively through representatives of their own choosing, and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection,” as well as the right “to refrain from any or all such activities.”

Section 8(a)(1) of the Act makes it an unfair labor practice for an employer “to interfere with, restrain, or coerce employees in the exercise of the rights guaranteed in Section 7” of the Act. For example, you may not

  • Threaten employees with adverse consequences, such as closing the workplace, loss of benefits, or more onerous working conditions, if they support a union, engage in union activity, or select a union to represent them.
  • Threaten employees with adverse consequences if they engage in protected, concerted activity. (Activity is “concerted” if it is engaged in with or on the authority of other employees, not solely by and on behalf of the employee himself. It includes circumstances where a single employee seeks to initiate, induce, or prepare for group action, as well as where an employee brings a group complaint to the attention of management. Activity is “protected” if it concerns employees’ interests as employees. An employee engaged in otherwise protected, concerted activity may lose the Act’s protection through misconduct.)
  • Promise employees benefits if they reject the union.
  • Imply a promise of benefits by soliciting grievances from employees during a union organizing campaign. (However, if you regularly solicited employee grievances before the campaign began, you may continue that practice unchanged.)
  • Confer benefits on employees during a union organizing campaign to induce employees to vote against the union.
  • Withhold changes in wages or benefits during a union organizing campaign that would have been made had the union not been on the scene, unless you make clear to employees that the change will occur whether or not they select the union, and that your sole purpose in postponing the change is to avoid any appearance of trying to influence the outcome of the election.
  • Coercively question employees about their own or coworkers’ union activities or sympathies. (Whether questioning is coercive and therefore unlawful depends on the relevant circumstances, including who asks the questions, where, and how; what information is sought; whether the questioned employee is an open and active union supporter; and whether the questioning occurs in a context of other unfair labor practices.)
  • Prohibit employees from talking about the union during working time, if you permit them to talk about other non-work-related subjects.
  • Poll your employees to determine the extent of their support for a union, unless you comply with certain safeguards. You must not have engaged in unfair labor practices or otherwise created a coercive atmosphere. In addition, you must (1) communicate to employees that the purpose of the poll is to determine whether the union enjoys majority support (and that must, in truth, be your purpose); (2) give employees assurances against reprisal; and (3) conduct the poll by secret ballot.
  • Spy on employees’ union activities. (“Spying” means doing something out of the ordinary to observe the activity. Seeing open union activity in workplace areas frequented by supervisors is not “spying.”)
  • Create the impression that you are spying on employees’ union activities.
  • Photograph or videotape employees engaged in peaceful union or other protected activities.
  • Solicit individual employees to appear in a campaign video.
  • Promulgate, maintain, or enforce work rules that reasonably tend to inhibit employees from exercising their rights under the Act.
  • Deny off-duty employees access to outside nonworking areas of your property, unless business reasons justify it.
  • Prohibit employees from wearing union buttons, t-shirts, and other union insignia unless special circumstances warrant.
  • Convey the message that selecting a union would be futile.
  • Discipline or discharge a union-represented employee for refusing to submit, without a representative, to an investigatory interview the employee reasonably believes may result in discipline.
  • Interview employees to prepare your defense in an unfair labor practice case, unless you provide certain assurances. You must communicate to the employee the purpose of the questioning, assure him against reprisals, and obtain his voluntary participation. Questioning must occur in a context free from employer hostility to union organization and must not itself be coercive. And questioning must not go beyond what is needful to achieve its legitimate purpose. That is, you may not pry into other union matters, elicit information concerning the employee’s subjective state of mind, or otherwise interfere with employee rights under the Act.
  • Initiate, solicit employees to sign, or lend more than minimal support to or approval of a decertification or union-disaffection petition.
  • Discharge, constructively discharge, suspend, layoff, fail to recall from layoff, demote, discipline, or take any other adverse action against employees because of their protected, concerted activities.

Washington DC – Virginia, August 11, 2016 – 143 Omniplex World Services Corporation armed security officers working at FDIC in Washington DC and Virginia have voted UNION YES by a score of 70-1 to become the newest members of the Law Enforcement Officers Security Unions (LEOSU-DC).

MedStar National Rehabilitation Hospital, Special Police Officers, Medstar Washington Hospital Center, Unionization

This victory comes off the heals of another great victory at Medstar Washington Hospital Center, whereby the special police officers, public safety officers and dispatchers voted in favor of LEOSU-DC representation. Not a day after winning that election the special police officers working at MedStar National Rehabilitation Hospital signed up to become members of the LEOSU-DC union joining the fight for RESPECT.

MedStar Washington Hospital Center is the largest private hospital in Washington, D.C. A member of MedStar Health, the not-for-profit Hospital Center is licensed for 926 beds.

We now welcome 143 armed Omniplex security officers working in Washington DC and Virginia to the LEOSU-DC family.

The FDIC Omniplex World Services Corporation security officers are presently represented by the Service Employees International Union, Local 32BJ who could not appear on the ballot. Upon certification by the National Labor Relations Board the Law Enforcement Officers Security Unions (LEOSU-DC) will now become the new exclusive bargaining representative for these FDIC Omniplex security officers.

During this campaign Service Employees International Union, Local 32BJ ran an all out UNION BUSTING campaign visiting the work sites and homes of these officers in their attempt to have them vote NO Union. In addition to the above, SEIU Local 32BJ union thugs ran a personal smear campaign against LEOSU-DC Director Steve Maritas.

The FDIC Omniplex World Services Corporation security officers working both in Washington DC and Virginia noted for the last 3 years SEIU Local 32BJ was no where to be found, charging unprecedented high dues and forcing Omniplex security officers into SEIU Local 32BJ’s healthcare program despite having their own healthcare coverage noted the majority of Omniplex security officers working at the FDIC.

Section 9(b)(3) of the Act prohibits the Board from certifying any labor organization “as the representative of employees in a bargaining unit of guards if such organization admits to membership, or is affiliated directly or indirectly with an organization which admits to membership, employees other than guards.” Local 32BJ is a labor organization which is affiliated directly or indirectly with an organization which admits non-guards as members, namely, Service Employees International Union. Accordingly, Local 32BJ is a mixed guard/non-guard union, and the Board is prohibited by Section 9(b)(3) from certifying Local 32BJ as the representative of a bargaining unit of guards. Further, the Board has held that mixed guard/non-guard unions are disqualified from taking advantage of the Board’s election processes, including the privilege of being placed on the ballot.’ See, University of Chicago, 272 NLRB 873, 876 (1984).

New Orleans LA Aug 15 2015 A group of offenders incarcerated at Bridge City Center for Youth attacked and overpowered a guard last week, allowing eight teens to bolt from their secured dorm, including two who managed to escape the property entirely, according to authorities.

While Riynell Nixon, 15, and Rashad Seals, 16, went on the lam Friday (Aug. 7), prompting a search by local law enforcement. The other six offenders never made it off-property, said Elizabeth Touchet-Morgan, spokeswoman for the Louisiana Office of Juvenile Justice.

Investigators Tuesday arrested Sanders Johnson, Juan Tapia, Armani Mouton and Martez Doucet, all 17, and Eric Curry, 19, and booked them with simple escape, according to arrest records. Juvenile Justice investigators also arrested and booked a 16-year-old boy accused of taking part in the escape, Touchet-Morgan said.

The attack occurred about 1:25 a.m. Friday in the boys’ Harmony dormitory at the facility, located at 3225 River Road, Bridge City. Tapia, Mouton, Curry and the unnamed 16-year-old grabbed a guard – referred to as a juvenile justice specialist by officials at the youth center – as he was standing near the door, according to arrest reports.

“They rushed him,” Touchet-Morgan said.

The four teens held the guard down as Seals tried to grab his keys. During the struggle, someone bit the guard’s hand, Touchet-Morgan said.

Seals managed to get the keys away from the guard and unlocked a back door. The teens also stole the guard’s portable radio and the dorm telephone, preventing him from contacting other staffers, the arrest reports said.

The guard finally alerted officials by waving frantically in front of security cameras installed in the dorm. The responding officers spotted the teens on the grounds and began chasing them around the facility, the arrest report said.

They eventually rounded up six of the offenders, but Nixon and Seals escaped through a hole in the perimeter fence, authorities said.

In addition to the simple escape charge, Tapia, Mouton, Curry and the 16-year-old were booked with battery of a correctional center employee while in custody.

Nixon’s relatives surrendered him to authorities on Saturday. Authorities arrested Seals in Baton Rouge on Sunday.

The escape was the second to occur at the youth center in a three-day period. Wilnor Chaney Jr., 18, escaped in a similar fashion by overpowering a guard to access keys during the early morning hours of Aug. 5, Touchet-Morgan said. He was recaptured and booked with simple escape and battery of a correctional center employee while in custody.

The Youth Center has come under scrutiny in the past for issues concerning understaffing and violence against employees. Following the escape, state officials are reviewing the policies and procedures at the facility as part of its investigation, Touchet-Morgan said.

“We look at our staffing to see if there is something we could do to make adjustments for employees,” she said.

That could include reviewing staff-to-youth ratios at the facility. All of the dorm-based employees are supported by other staffers, including shift supervisors and roaming specialist and staff in the control center, according to Touchet-Morgan.

“There are a lot of variables to look at and we’re looking at all of them,” she said. “It’s a facility and processes break down. We want to make sure that we keep that from happening, again.”

Los Angeles CA Aug 15 2015 A recent attack on security guards by youths staying at a transitional center for older foster children with nowhere else to go prompted a call Friday for beefed up security at the facility.

The Youth Welcome Center, housed on the campus of Los Angeles County-USC Medical Center, is a last-resort place for foster children ages 12 and older who have nowhere else to go.
Many of the youths are older teens who have been thrown out of multiple foster homes or are difficult to place. The facility is supposed to house the children for 24 hours, but many end up staying considerably longer.

In February, the Times reported on issues at the facility, including youths being recruited for prostitution. Four months later, a special committee appointed by the county Board of Supervisors recommended that they shut the center down.

On Saturday, three youths at the center attacked two security guards, said Amara Suarez, a spokeswoman for the Los Angeles County Department of Children and Family Services. She said it was unclear what sparked the assault, but it “may have been related to the youths not following instructions as they were being processed into the center.”

A staffer captured a portion of the melee on video and it was later shared with the Times.

Suarez said the youths remained at the center after the incident, but on Tuesday got into another fight with a guard, and one youth was arrested.

She said a sheriff’s deputy is now on duty at the center around the clock.

County Supervisor Hilda Solis, who represents the area, said in statement that she had directed Department of Children and Family Services Director Philip Browning to take further measures to improve safety and security at the center and to “help find alternative placement for the most at-risk minors” and provide mental health services to those who need them.

Riverside CA Aug 15 2015 A man who police believe knocked out and then beat a security guard while he was unconscious has been arrested.

Anthony James Pearce, 27, was arrested at 5 p.m. Wednesday, Aug. 12, and booked into the Southwest Detention Center on suspicion of battery causing serious injury, assault with a deadly weapon other than a firearm and committing a crime while in a post-release community supervision program, jail logs show.

He is being held in jail without bail, the logs show.

The security guard, José Sigaran, had a broken nose and damage to his eyes that left him blind for several days, he said in an interview Friday, Aug. 14.

He had no injuries to the rest of his body, he said.

“I think he really just wanted to destroy my face,” Sigaran said.

The beating was sparked by a run-in he had with the suspect while working guard duty at the downtown bus terminal on University Avenue near Market Street Tuesday morning, Aug. 11, Riverside police officials said in a news release.

The guard saw Pearce, who loiters around the terminal regularly, smoking marijuana, Sigaran said.

When he ordered the suspect to leave, Pearce complied, but he made threats against the guard’s life as he left, Sigaran said.

About an hour later — about noon — the victim was walking to a nearby grocery store when Pearce ambushed him in front of Jersey Burger in the 3900 block of University Avenue, Sigaran said.

What happened next was a blur to the guard, he said, but he thinks the suspect hit him with his skateboard, knocking him out.

But that didn’t stop the suspect, police said.

Pearce stood over Sigaran’s unconscious body and punched him repeatedly in the face, Riverside police Officer Cheryl Hayes said.

Paramedics took the man to a hospital where he got stitches and was referred to specialists to get surgery on his nose and eye sockets, he said.

After the attack, officers got surveillance video from a local business and saw the suspect. He was recognizable by his distinctive shoes, socks and skateboard, the release said.

The next day about 4:20 p.m., an officer spotted Pearce near Mission Inn Avenue and Orange Street. He resembled the man in the video, so the officer took him into custody, police said.

At a police station, Pearce admitted to being involved in the fight, the release said.

Sigaran is a kind man and a great husband and father of five, said Danielle Cott, an Irvine resident and long-time friend.

“He’s a calm, good guy,” she said. “There’s nothing he would have done to provoke this.”
