The National Labor Relations Board protects the rights of most private-sector employees to join together, with or without a union, to improve their wages and working conditions.

Section 7 Rights and Freedoms

Employees have the right to unionize, to join together to advance their interests as employees, and to refrain from such activity. It is unlawful for an employer to interfere with, restrain, or coerce employees in the exercise of their rights. For example, employers may not respond to a union organizing drive by threatening, interrogating, or spying on pro-union employees, or by promising benefits if they forget about the union.

Section 7 of the National Labor Relations Act (the Act) guarantees employees “the right to self-organization, to form, join, or assist labor organizations, to bargain collectively through representatives of their own choosing, and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection,” as well as the right “to refrain from any or all such activities.”

Section 8(a)(1) of the Act makes it an unfair labor practice for an employer “to interfere with, restrain, or coerce employees in the exercise of the rights guaranteed in Section 7” of the Act. For example, you may not

  • Threaten employees with adverse consequences, such as closing the workplace, loss of benefits, or more onerous working conditions, if they support a union, engage in union activity, or select a union to represent them.
  • Threaten employees with adverse consequences if they engage in protected, concerted activity. (Activity is “concerted” if it is engaged in with or on the authority of other employees, not solely by and on behalf of the employee himself. It includes circumstances where a single employee seeks to initiate, induce, or prepare for group action, as well as where an employee brings a group complaint to the attention of management. Activity is “protected” if it concerns employees’ interests as employees. An employee engaged in otherwise protected, concerted activity may lose the Act’s protection through misconduct.)
  • Promise employees benefits if they reject the union.
  • Imply a promise of benefits by soliciting grievances from employees during a union organizing campaign. (However, if you regularly solicited employee grievances before the campaign began, you may continue that practice unchanged.)
  • Confer benefits on employees during a union organizing campaign to induce employees to vote against the union.
  • Withhold changes in wages or benefits during a union organizing campaign that would have been made had the union not been on the scene, unless you make clear to employees that the change will occur whether or not they select the union, and that your sole purpose in postponing the change is to avoid any appearance of trying to influence the outcome of the election.
  • Coercively question employees about their own or coworkers’ union activities or sympathies. (Whether questioning is coercive and therefore unlawful depends on the relevant circumstances, including who asks the questions, where, and how; what information is sought; whether the questioned employee is an open and active union supporter; and whether the questioning occurs in a context of other unfair labor practices.)
  • Prohibit employees from talking about the union during working time, if you permit them to talk about other non-work-related subjects.
  • Poll your employees to determine the extent of their support for a union, unless you comply with certain safeguards. You must not have engaged in unfair labor practices or otherwise created a coercive atmosphere. In addition, you must (1) communicate to employees that the purpose of the poll is to determine whether the union enjoys majority support (and that must, in truth, be your purpose); (2) give employees assurances against reprisal; and (3) conduct the poll by secret ballot.
  • Spy on employees’ union activities. (“Spying” means doing something out of the ordinary to observe the activity. Seeing open union activity in workplace areas frequented by supervisors is not “spying.”)
  • Create the impression that you are spying on employees’ union activities.
  • Photograph or videotape employees engaged in peaceful union or other protected activities.
  • Solicit individual employees to appear in a campaign video.
  • Promulgate, maintain, or enforce work rules that reasonably tend to inhibit employees from exercising their rights under the Act.
  • Deny off-duty employees access to outside nonworking areas of your property, unless business reasons justify it.
  • Prohibit employees from wearing union buttons, t-shirts, and other union insignia unless special circumstances warrant.
  • Convey the message that selecting a union would be futile.
  • Discipline or discharge a union-represented employee for refusing to submit, without a representative, to an investigatory interview the employee reasonably believes may result in discipline.
  • Interview employees to prepare your defense in an unfair labor practice case, unless you provide certain assurances. You must communicate to the employee the purpose of the questioning, assure him against reprisals, and obtain his voluntary participation. Questioning must occur in a context free from employer hostility to union organization and must not itself be coercive. And questioning must not go beyond what is needful to achieve its legitimate purpose. That is, you may not pry into other union matters, elicit information concerning the employee’s subjective state of mind, or otherwise interfere with employee rights under the Act.
  • Initiate, solicit employees to sign, or lend more than minimal support to or approval of a decertification or union-disaffection petition.
  • Discharge, constructively discharge, suspend, layoff, fail to recall from layoff, demote, discipline, or take any other adverse action against employees because of their protected, concerted activities.

West Valley, New York – August 12, 2016 – AlliedBarton Special Police Officers I, Sergeant/Police Officer II, Alarm Monitors & Senior Alarm Monitors working at West Valley Demonstration Project (WVDP) in West Valley, New York all voted unanimously to join the Law Enforcement Officers Security Unions (LEOSU).

The West Valley Demonstration Project is a unique operation within the Department of Energy. It came into being through the West Valley Demonstration Project Act of 1980. The Act requires that the Department is responsible for solidifying the high-level waste, disposing of waste created by the solidification, and decommissioning the facilities used in the process. The land and facilities are not owned by the Department. Rather, the project premises are the property of the New York State Energy Research and Development Authority (NYSERDA) and represents only 200 acres of the larger Western New York Service Center, which is approximately 3,300 acres, also owned by NYSERDA. After DOE’s responsibilities under the Act are complete, the Act requires that the premises be returned to New York State. Until that time, the Act requires New York State to pay 10 percent of the Project costs, and the Department pays the remaining 90 percent.

Universal Protection Service Security Officers, New Jersey

Universal Protection Service Security Officers working on the Docks of New Jersey have voted unanimously to Join the Law Enforcement Officers Security Unions (LEOSU).

Jersey City New Jersey- On April 4, 2016 the security officers who work on the New Jersey docks for Universal Protection Service UPS voted unanimously to Join the Law Enforcement Officers Security Unions (LEOSU).

The National Labor Relations Board (NLRB) in Newark ran the mail ballot election.

Steve Maritas, Organizing Director for the LEOSU Union noted that these Universal Protection Service Security Officers have to have special waterfront licenses to work on the docks of New Jersey, and as such should be compensated by their special training according to the area rate or above.

Maritas noted, once we are certified by the National Labor Relations Board (NLRB) which should be in about ten (10) days, the Union, LEOSU and its attorney’s will begin the process of collective bargaining to improve wages, benefits and other conditions of employment.

The Law Enforcement Officers Security Unions (LEOSU) affiliated with the Law Enforcement Security & Police Benevolent Association (LEOS-PBA) have recently won several elections in the Washington DC area and presently are awaiting results of mail ballot elections. In addition the LEOSU is presently in the process of organizing several other locations in New York, New Jersey, Washington DC, Rhode Island, North Carolina and throughout the United States.

Fabricio M. Rodriguez, Security Guards, Philadelphia troublemaker, hell-raiser, outside agitator

Fabricio Rodriguez is a Philadelphia troublemaker, hell-raiser, outside agitator and organizer. In other words, he’s a professional protester who helps empower workers, immigrants and communities to fight for their rights. He founded the local Restaurant Opportunities Center and the independent Philadelphia Security Officers Union, and he currently works for POWER Interfaith, which works to ensure that the needs and priorities of all Philadelphians are reflected in the systems and policies that shape the city. Fabricio is also a board member of Bread and Roses Community Fund and the Windcall Institute, and he blogs about his organizing experiences at ThatFinalStraw.com.

The seeds of protest were sewn within Fabricio Rodriguez fifteen years ago when he and his father were fired from their jobs in an Alaskan subsurface mine after demanding their legal right to take a lunch break. When that protest eventually led to lunch breaks for all the miners, Rodriguez realized that the only rights we have are the ones we take. In this dynamic, surprising and riveting account of his life as a professional troublemaker, Rodriguez describes how protest needn’t be only angry – it can also be beautiful, fun, musical or faith-filled – and declares that direct action remains the best tool we have to re-set the agenda of the powerful.

Private and religious schools will be able to hire security guards and get reimbursed by the city, thanks to a new law Mayor Bill de Blasio signed on Jan. 5.

Under the new law, which goes into effect on April 1, non-public schools that have enrollments of 300 or more students will be allowed to receive reimbursements from the city to cover the costs of hiring and training security guards.

DETROIT (WJBK) – A step to help ease financial stress on Detroit Public Schools is causing concern. Parents and students are reacting to the news that the district is cutting security guards at a handful of schools.

It’s no secret DPS is in financial trouble. The Detroit News reports the district will begin making $26 million payments to the state in February and could be out of money as early as April.

DPS contracts the security guards from Securitas and says the reduction was part of its annual budgeting process.

Union Busting, Tactics, Persuader Rule

Union busting is a pejorative term used by media, labor organizations, and others worldwide to describe a wide range of activities undertaken by employers, their proxies, and governments, which attempt to disrupt or prevent the formation or expansion of trade unions. The term “union busting” is used in current vernacular to describe activities in labor relations that do not favor unions. Union busting tactics can range from legal to illegal and subtle to violent. Labor laws exist country to country differing greatly in level and type of regulation or protection of unions, organizing, and other aspects of labor relations. These can affect such topics as posting notices/communications, organizing inside or outside employer property, solicitations, card signing, union dues, picketing, work stoppages, striking, strikebreaking, lockouts, dismissals or termination of employment, permanent replacements, automatic recognition, derecognition, ballot elections, employer-controlled trade unions and more. Article 23 of the Universal Declaration of Human Rights declares that everyone has a right to form and/or join a trade union.

Union Busting?

Union-busting is a practice that is undertaken by an employer or their agents to prevent employees from joining a labor union, or to disempower, subvert, or destroy unions that already exist.

Union busting is a field populated by bullies and built on deceit. A campaign against a union is an assault on individuals and a war on truth. As such, it is a war without honor. The only way to bust a union is to lie, distort, manipulate, threaten, and always, always attack.

PERSUADER RULE MOVES TO OMB: The Labor Department sent its long-delayed “persuader rule” to the Office of Management and Budget, according to several people familiar with the matter, including a senior administration official.

A key provision in the final rule would narrow the range of union-busting activities exempt from public disclosure under the Labor Department’s “advice exception.” Management-side attorneys who don’t deal directly with workers often use this exception, citing attorney-client privilege, to keep their anti-union activities under wraps.

But the Labor Department concluded in 2011 that its “advice exception” might be overbroad, noting that “the consultant may have devised and orchestrated certain, or even all, aspects of activities with a direct or indirect object to persuade employees about their rights to organize and bargain collectively.” OMB review is a key prerequisite for finalizing the rule. In its unified agenda released last month, the Labor Department said it hoped to finalize the regulation by March.

DOL’s Persuader Rule Advances

After years in regulatory limbo, the Department of Labor’s final revisions to the so-called “persuader” rule have moved one step closer to publication.  On December 7, the DOL’s Office of Labor-Management Standards (OLMS) submitted the final rule to the Office of Management and Budget (OMB), which is the final step before the rule can be published in the Federal Register. Although the DOL’s regulatory agenda had estimated this rule would be published in March 2016, given the OMB’s traditional review timetable, the measure could be released even earlier in 2016. If the final rule resembles the proposal issued in 2011, it will have a significant impact on employers.

Unions are about a simple proposition: By joining together, working women and men gain strength in numbers so they can have a voice at work about what they care about. They negotiate a contract with their employer for things like a fair and safe workplace, better wages, a secure retirement and family-friendly policies such as paid sick leave and scheduling hours. They have a voice in how their jobs get done, creating a more stable, productive workforce that provides better services and products. Always adapting to the challenges of our nation’s evolving workforce, unions are meeting the needs of workers in today’s flexible and nontraditional work environments. Because no matter what type of job workers are in, by building power in unions, they can speak out for fairness for all working people in their communities and create better standards and a strong middle class across the country.

THE UNION DIFFERENCE

Union members earn better wages and benefits than workers who aren’t union members. On average, union workers’ wages are 27 percent higher than their nonunion counterparts.

Unionized workers are 54 percent more likely to have employer-provided pensions.

More than 83 percent of union workers have jobs that provide health insurance benefits, but only 62 percent of nonunion workers do. Unions help employers create a more stable, productive workforce—where workers have a say in improving their jobs.

Unions help bring workers out of poverty and into the middle class. In fact, in states where workers don’t have union rights, workers’ incomes are lower.

WHO ARE UNION MEMBERS?

There are over 60 unions representing over 14 million workers throughout the country.

No matter what work you do, there’s a union that represents your work. Teachers and miners, firefighters and farm workers, bakers and engineers, pilots and public employees, doctors and nurses, patients and plumbers, bus drivers, office workers and computer professionals are all union members.

BENEFITS OF BELONGING TO A UNION

One of the big reasons workers join a union is to ensure fair treatment in the workplace.  As a union member, you have a collective voice regarding:

  • work hours,
  • benefits – including retirement plans, health insurance, vacation and sick leave, tuition reimbursement, etc.,

    • workplace health and safety,

Another advantage of belonging to a union is that members earn 30% more than non-union workers.  And if you’re a union worker, you are also much more likely to have health and pension benefits.

HOW DO UNIONS WORK?

A labor or trade union is an organization of workers dedicated to protecting members’ interests and improving wages, hours and working conditions for all. No matter what you do for a living, there’s a union with members who do the same thing. Unions represent:

HERE’S HOW UNIONS WORK TO MAKE AMERICA STRONG

Unions work like a democracy. They hold elections for officers who make decisions on behalf of members.

A local union is a locally-based group of workers.  A local may include workers from the same company or region. It may also have workers from the same business sector, employed by different companies.

Did you know there are over 60 national/international unions that represent millions of workers across America and Canada? It starts with the formation of a bargaining unit. This is a group represented by a union for dealing with an employer. This group of workers must either be voluntarily recognized by their employer, or a majority of workers in the bargaining unit must vote for representation.

It is legal for employers to try to persuade employees not to unionize. However, it is illegal for an employer to prevent employees from unionizing through threats, violence, and other coercive action. It is also illegal for unions to use lies or threats of violence to intimidate employees into joining.

  1. An employer is required by law to bargain in good faith with a union, although an employer is not required to agree to any particular terms. Once an agreement is reached through negotiations, a collective bargaining agreement (CBA) is signed. A CBA is a negotiated agreement between a labor union and an employer that sets terms of employment for members of that union including wages, hours, conditions, vacation, sick days, and benefits.
  2. After a CBA is signed, an employer can’t change details of the agreement without the union representative’s approval. The CBA lasts for a set period of time with the union monitoring to assure the employer abides by the contract. If a union believes an employer has breached the CBA, the union can file a grievance, which may be resolved through arbitration.
  3. As with many other organizations, union costs are paid by member dues that typically cost about $50 a month. Most unions have paid staff to manage their operations. While some staff may be paid by union dues, members also often volunteer.

COLLECTIVE BARGAINING

Collective bargaining is the process in which working people, through their unions, negotiate contracts with their employers to determine their terms of employment, including pay, benefits, hours, leave, job health and safety policies, ways to balance work and family and more. Collective bargaining is a way to solve workplace problems.

After the rights of public employees to collectively bargain for a middle-class life came under attack in 2010, working people in all kinds of jobs as well as students, community supporters, faith leaders and others united to defend this basic right.

The United States has long lagged behind other industrialized nations in collective bargaining coverage for public- and private-sector workers. Yet the right to collectively bargain is essential so that working men and women have the strength to improve their living standards, provide for their families and build a strong middle class.

WHAT IS THE ORIGIN OF LABOR UNIONS?

The origin of labor unions dates back to the eighteenth century and the industrial revolution in Europe. During this time there was a huge surge of new workers into the workplace that needed representation.

In the United States history of unions, early workers and trade unions played an important part in the role for independence. Although their physical efforts for the cause of independence were ineffective, the ideas they introduced, such as protection for workers, became part of our American culture.

LABOR UNION HISTORY IN THE U.S. BEGAN IN THE 19TH CENTURY

The history of unions in the United States exploded in the nineteenth century with the founding of the National Labor Union (NLU) in 1866. Unlike today’s unions, the NLU was not exclusive to a particular type of worker. And although the NLU crumbled without making significant gains in establishing workers’ rights, its founding set an important precedent in our country.

Soon after, the Knights of Labor emerged in 1869. This group’s membership peaked at about 700,000 and its efforts were focused on addressing key issues such opposition to child labor and demands for an eight-hour day.
