Union busting is a pejorative term used by media, labor organizations, and others worldwide to describe a wide range of activities undertaken by employers, their proxies, and governments, which attempt to disrupt or prevent the formation or expansion of trade unions. The term “union busting” is used in current vernacular to describe activities in labor relations that do not favor unions. Union busting tactics can range from legal to illegal and subtle to violent. Labor laws exist country to country differing greatly in level and type of regulation or protection of unions, organizing, and other aspects of labor relations. These can affect such topics as posting notices/communications, organizing inside or outside employer property, solicitations, card signing, union dues, picketing, work stoppages, striking, strikebreaking, lockouts, dismissals or termination of employment, permanent replacements, automatic recognition, derecognition, ballot elections, employer-controlled trade unions and more. Article 23 of the Universal Declaration of Human Rights declares that everyone has a right to form and/or join a trade union.
WHAT IS Union Busting?
Union-busting is a practice that is undertaken by an employer or their agents to prevent employees from joining a labor union, or to disempower, subvert, or destroy unions that already exist.
Union busting is a field populated by bullies and built on deceit. A campaign against a union is an assault on individuals and a war on truth. As such, it is a war without honor. The only way to bust a union is to lie, distort, manipulate, threaten, and always, always attack.

PERSUADER RULE MOVES TO OMB: The Labor Department sent its long-delayed “persuader rule” to the Office of Management and Budget, according to several people familiar with the matter, including a senior administration official.

A key provision in the final rule would narrow the range of union-busting activities exempt from public disclosure under the Labor Department’s “advice exception.” Management-side attorneys who don’t deal directly with workers often use this exception, citing attorney-client privilege, to keep their anti-union activities under wraps.
But the Labor Department concluded in 2011 that its “advice exception” might be overbroad, noting that “the consultant may have devised and orchestrated certain, or even all, aspects of activities with a direct or indirect object to persuade employees about their rights to organize and bargain collectively.” OMB review is a key prerequisite for finalizing the rule. In its unified agenda released last month, the Labor Department said it hoped to finalize the regulation by March.
After years in regulatory limbo, the Department of Labor’s final revisions to the so-called “persuader” rule have moved one step closer to publication. On December 7, the DOL’s Office of Labor-Management Standards (OLMS) submitted the final rule to the Office of Management and Budget (OMB), which is the final step before the rule can be published in the Federal Register. Although the DOL’s regulatory agenda had estimated this rule would be published in March 2016, given the OMB’s traditional review timetable, the measure could be released even earlier in 2016. If the final rule resembles the proposal issued in 2011, it will have a significant impact on employers.

An unarmed security guard was on duty at the San Bernardino social services center where terrorism suspects Syed Rizwan Farook and Tashfeen Malik drove up in a black SUV, exited the vehicle equipped with masks and rifles and killed 14 people at an office holiday party, a spokeswoman for the center said Friday.
Leeza Hoyt, a public relations specialist hired by the Inland Regional Center — which serves people with developmental disabilities — said she was not sure where the guard was when Farook and Malik arrived and carried out their assault. The guard, she said, typically “roves the parking lot” of the sprawling complex.
The ineffectiveness of the unarmed guard in stopping the San Bernardino assault could revive the ongoing debate over expanding armed security, be it private guards or police officers, to public places in order to cope with the wave of mass shootings in the U.S. over the past several years.
On December 2, 2015, Syed Rizwan Farook and Tashfeen Malik, a married couple, shot and killed 14 people and injured 21 others at the Inland Regional Center in San Bernardino, California, United States. They targeted a San Bernardino County Department of Public Health training event and holiday party with about 80 employees in attendance at the rented auditorium. Before the shooting, Syed Farook had attended the event as an employee. After the shooting, the couple fled in an SUV. About four hours later, the two perpetrators were pursued in their vehicle by police and killed during an exchange of gunfire. The FBI began a counter-terrorism investigation because of the equipment used, the couples’ recent travel to the Middle East, and the discovery of a Facebook post attributed to Malik in which she pledged allegiance (Bay’ah) to the caliph of the Islamic State of Iraq and the Levant (ISIL), close to time of the shooting. The attack was the second-deadliest mass shooting in California after the 1984 San Ysidro McDonald’s massacre, and the deadliest in the U.S. since the 2012 Sandy Hook Elementary School shooting.

In Many States, Security Guards Get Scant Training, Oversight
Forty-one states, plus the District of Columbia, license security officers, but requirements vary greatly from state to state.
At an Iowa mall, a security guard allegedly shot and killed a woman who worked at a children’s museum there. At a Kentucky distillery, a security guard accepted money from thieves to look the other way while they stole more than $100,000 in expensive whiskey. And in a Virginia hospital, a 64-year-old man suffered a serious head injury and later died after a violent altercation with a security guard.
Recent incidents like these have drawn fresh attention to the screening, training and state oversight of private security officers, and have prompted some legislators to push for stricter regulation—efforts that have been largely unsuccessful this year.
“We’ve got to feel comfortable that people who have a badge on are, in fact, trained—and trained well,” said Michigan state Sen. Darwin Booher, a Republican who sponsored a set of bills, still pending, that would update regulations on security guards in the state.
About 90 bills were introduced in state legislatures this year dealing with the licensing and training of security officers or requirements for security companies, according to Steve Amitay, director of the National Association of Security Companies (NASCO), an industry group. In recent years, similar numbers of measures have been proposed. None of this year’s bills that would have substantially toughened state requirements was enacted, Amitay said.
“In some of these states, it’s a very anti-regulatory environment and they think any additional regulation on businesses or people performing services is bad,” Amitay said. “With other folks, it’s a resource issue. For the state to start regulating an industry and requiring licenses requires initial appropriations and startup costs.”
